What is an SWQ Permit?

A Stormwater Quality (SWQ) Permit is an approval issued by either the city or county that ensures a construction project includes measures to manage and reduce pollution in stormwater runoff, both during and after construction. The most commonly permitted Permanent Storm Water Quality Features (PSWQF) are ponds and stormwater interceptors. However, this begs the question as to how one obtains an SWQ Permit?

After the engineering drawings have been approved the permitting process involves the submission of an affidavit to the public which is recorded with the county clerk, application fees, and a Stormwater Quality Management Plan (SWQMP). However, a Stormwater Quality Permit only lasts a year and requires annual renewal. Below is some information about city and county requirements when it comes to obtaining, applying for, and maintaining a Stormwater Quality Permit.

City of Houston

  • The City of Houston requires Storm Water Quality permits for new developments greater than or equal to 1 acre, or significant redevelopments greater than 0.2 acres.
  • A SWQ permit application includes a Storm Water Quality Management Plan, Professional Engineering certification, an owner’s affidavit, registry recording, and standard details.
  • There are cases where the owner or operator of a stormtrooper differs from the original permitter of the Permanent Storm Water Quality Feature, and in these cases the city may require you to transfer ownership of the PSWQF. This transference may incur fees. SSCI’s team is able to resolve these discrepancies on renewals.

Harris County

  • Harris County requires SWQ permits to be renewed annually.
  • Harris County requires that you provide a waste manifest annually proving that you have cleaned your stormwater interceptor, if present.
  • Some tips for SWQ permitting with Harris county:
    • Retain copies of all documentations related to your SWQ permit
    • Be prepared for annual renewals
    • Ensure PSWQF’s are properly maintained
    • To avoid late fees and penalties submit renewal documents before the expiration date, but no earlier than 30 days from the expiration date
    • If your project is greater than or equal to 5 acres an NOI will be necessary.
