Is Your Facility Ready for the 2026 TPDES Renewal? - SSCI Environmental
Hazardous materials are used and stored in many industrial, educational, commercial, and public facilities. When properly managed, these materials support essential operations. When containers leak, materials are stored outdoors without adequate protection, or wastes are improperly handled, they can create safety concerns, environmental impacts, and regulatory exposure.
A comprehensive environmental-compliance program should address the complete life cycle of these materials—from purchasing and storage through use, waste generation, transportation, and final disposal. It should also prevent pollutants from coming into contact with stormwater.
Connecting Material Management to Your SWPPP
A Stormwater Pollution Prevention Plan (SWPPP or SWP3) should identify material and waste-storage areas that could contribute pollutants to stormwater.
The plan should address outdoor storage, loading and unloading, fueling, equipment maintenance, spill prevention, secondary containment, employee training, inspections, outfalls, and corrective actions.
Your SWP3 should reflect actual facility conditions and be updated whenever operations, materials, drainage patterns, outfalls, or control measures change.
TPDES RENEWAL REMINDER
Facilities currently covered under the TPDES Multi-Sector General Permit, TXR050000, must complete the applicable renewal requirements by November 12, 2026.
Depending on the facility, this may require:
- Submitting a new Notice of Intent;
- Submitting a No Exposure Certification; or
- Confirming eligibility for automatic authorization.
Before submitting an NOI, the facility’s SWP3 must be reviewed, updated, implemented, and certified under the 2026 permit requirements.
Do not wait until the deadline. Allow time to update the SWP3, verify facility and outfall information, review monitoring requirements, and resolve any STEERS access or signatory issues.

Environmental Compliance Updates
Texas Waste Reporting Is Going Digital
Beginning October 1, TCEQ requires applicable Industrial and Hazardous Waste Monthly Summary and Payment Reports to be submitted electronically through STEERS. Facilities should make sure the appropriate personnel have STEERS access and are prepared for the new reporting process.
Texas Hazardous Waste Rules Under Review
TCEQ is moving forward with proposed revisions to portions of its industrial and hazardous waste regulations. The changes involve Texas' RCRA authorization as well as permitting and financial capability requirements. Waste generators and permitted facilities should watch for adoption and implementation information from TCEQ.
Wetland Jurisdiction Rules Continue to Evolve
EPA and the U.S. Army Corps of Engineers are continuing work on a revised definition of Waters of the United States. The eventual rule could affect how wetlands, streams, drainage features and other waters are evaluated for federal Clean Water Act jurisdiction. Property owners planning development should continue to evaluate potential aquatic resources early in the due-diligence process.
